New $6.8 million air center at Ford Airport clears hurdle with judge's ruling - MLive.com

GRAND RAPIDS, MI — Leaders at Gerald R. Ford International Airport did not act improperly in approving a new $6.8 million private air center expected to begin taking shape this spring, a Kent County judge ruled last week.

The ruling, issued Friday by Judge James Robert Redford, effectively clears the way for construction to begin on the center being built by Muskegon-based Rothbury Executive Air on a 5-acre plot at the airport.

Two private air services already operating at the airport, Northern Air and Grand Rapids Air Center, alleged the board violated its own rules in approving the air center during two separate votes this year and last.

Northern Air and Grand Rapids Air Center claimed Ford Airport Board Chair Joseph Tomaselli violated the board’s standing rules by casting votes for the project because those guidelines only allow voting by the chair under certain circumstances.

The air services requested Redford issue a writ of mandamus, a judicial ruling that would have compelled Ford Airport’s six-person board to re-tally the May 2011 and Feburary 2012 that approved a zoning variance and lease agreement for Rothbury Executive Air.

In his nine-page ruling, Redford said Northern Air and Grand Rapids Air Service have no legal standing to force Ford Airport to adhere to its internal procedures, one of four conditions in issuing a writ of mandamus.

In denying the writ, Redford also pointed to a Federal Aviation Administration complaint filed in November 2011 against the airport by Northern Air and Grand Rapids Air Service over the approved zoning variance.

“The court is satisfied that plaintiffs are seeking an alternative administrative remedy at the same time they are requesting mandamus relief from this court,” Redford wrote in his ruling, referencing the FAA complaint. “Mandamus is only appropriate where ‘no other remedy exists that might achieve the same result.’”

Redford also denied Northern Air and Grand Rapids Air Center’s motion to issue a preliminary injunction against Executive Air’s new center, saying Ford Airport likely would incur “significant financial losses” as a result.

Robert Buchanan, Ford Airport’s attorney, said the airport is “pleased” and “vindicated” by Redford’s ruling.

“But by the same token, we feel as though we shouldn’t have had to go through that exercise,” Buchanan said. “The board isn’t in the business of reacting, it’s in the business of trying to pursue business opportunities, positive business opportunities, and this is just not helpful to have this kind of adversarial relationship over an issue like that.”

In a statement, Todd Dickinson, attorney for Northern Air, said Redford’s ruling against his client “will not alter the progress of our FAA administrative complaint.”

Dickinson went on to say the FAA complaint illustrates Ford Airport discriminated against Northern Air and Grand Rapids Air Center, and gave preferential treatment to Executive Air.

“We remain confident that the FAA will respond favorably to our complaint and require the Airport Board to correct these discriminatory practices or face the loss of federal funding, including the airport’s estimated $43 million, five-year capital improvement plan,” Dickinson said.

Leaders at Executive Air, which had planned to break ground in early May on the $6.8 million center, said those plans have been pushed back by about a month.

In a statement, Executive Air’s leaders said they are pleased with Redford’s ruling.

“We anticipated today’s favorable outcome … and continue to move forward with our exciting project,” the statement said.

Tri-Cities Regional Airport flying high - TriCities.com

They’re flying right at the Tri-Cities Regional Airport, using a federal grant-supported project to improve commercial air operations, and to increase business opportunities and commerce near the facility.

Airport Executive Director Patrick Wilson said the $10 million project will improve efficiency and safety by extending a taxiway. The work also requires moving Hamilton Road farther away from the jet traffic, which in itself could be considered safer for those who drive that route. But that road adjustment also gives the airport more room for business development, such as airplane repair and maintenance shops, at the south end of the facility. That could mean new business for our region, and possibly new jobs, which are sorely needed.

Protecting passengers, airport employees and those who live and work near the airport must be a priority for airport officials, but compliments are due to their efforts to also consider economic development opportunities in the design of the work.

Blueprint good for creating jobs in region

Jobs being important to improving our regional economy, the Appalachian Prosperity Project is to be commended for developing a blueprint for developing small businesses. The blueprint should be adopted and followed as much as possible – because small businesses are significant drivers in new job creation.

The U.S. Department of Labor’s Bureau of Labor Statistics reports that 65 percent of the 15 million jobs created between 1993 and 2009 where the result of small firms. And if we desire to restore the jobs lost during the recent recession, we must focus on this valuable avenue.

Believing that Southwest Virginia is fertile ground for “budding and expanding entrepreneurial ventures,” the blueprint’s designers outlined several specific tools to foster that activity. Chief among them is developing a one-stop place or center where budding entrepreneurs can seek help – whether to answer a question about a business license or to learn about loan opportunities for buying new equipment.

The blueprint designers acknowledged that there are many existing agencies currently helping those desiring to start new businesses, but which call should be made first often remains a perplexing stumbling block. And that’s a block such a resource center can remove with ease.

Tenn. judge’s plight highlights drug woes

He should be ashamed. He should also seek help – and be given every opportunity to find assistance and turn his life around.

More importantly, the convictions thrown into question by the fact that a Tennessee judge was high on drugs while sitting on the bench should be reviewed carefully. Criminal Court Judge Richard Baumgartner’s impaired judgment while serving as judge is more than sufficient reason to believe the defendants in the cases he oversaw did not receive a fair trial.

That particularly goes for those who came before his court for drug charges.

Both the American Medical Association and the American Psychiatric Association have for years stood their ground that addiction is a disease. Addiction is not a flagrant dismissal of willpower, nor character flaw, nor merely poor choice; it is a disease and it is not a crime.

That’s not to say that addicted people don’t commit crimes; they certainly do.

So it is appropriate, too, that Baumgartner was charged with and pleaded guilty to a single count of official misconduct.

But in a nation that jails more people than any other country in the world, according to our U.S. Justice Department, and a vast majority of them on drug charges, Baumgartner’s misfortune serves as an ironic bell ringer that this country is failing miserably in efforts to correct the social ills associated with addictions.

Business : Dubai and Dallas airport zones ink alliance pact

DUBAI ? The frees zone of Dubai Airport and foreign trade zone of Dallas/ Fort Worth International Airport, agreed on Sunday to join hands to create a ?cooperative business channel? aimed at exchanging expertise and benefiting from business opportunities in global market. Dr Mohammed Al Zarooni, Director-General of Dubai Airport Freezone, or Dafz, and Jeffery P. Fegan, chief executive of Dallas/Fort Worth International Airport, or DFW, signed a Memorandum Of Understanding to set forth a framework for a collaborative alliance between the two organisations.

Shaikh Ahmed bin Saeed Al Maktoum, Chairman of DAFZ, and Mike Rawlings, Mayor of the City of Dallas, and other senior officials from both DAFZ and DFW were present on the occasion.

The signing of the MoU formalised the establishment of a Free Trade Zone Alliance between the two parties and outlined the framework of exchanging expertise, and benefiting from business opportunities.

Dr Zarooni said American businesses are among the 10 most active companies in the Freezone and through increased bilateral relations with DFW, DAFZ hopes to take advantage of the business opportunities available in the DFW region. “The non-stop direct flight services between Dubai and DFW announced last month will provide a major boost to the trade relations between the two cities.”

“Through this alliance, we aim at creating a platform to conduct joint promotional activities using the most efficient and effective approaches to capture on any and all opportunities of cooperation to achieve our shared goals. We foresee vast potential in the future cooperation that is expected to come out of the MoU,” said Dr Zarooni.

He said both airport zones could mutually benefit from the alliance by creating a cooperative business channel.

“The key objectives of signing this MOU are to exchange expertise, initiate and provide ideas and thoughts through open consultation and communications.

Together, we would like to take advantage of the business opportunities available in both cities and the ones resulting from the new non-stop air services commenced between Dubai and Dallas last month,” he said.

The alliance also seeks to create a platform to conduct joint promotional activities using the most efficient and effective approaches to capture opportunities of cooperation to achieve both sides’ shared goals.

Fegan said DFW, the fourth busiest airport for operations in the world, and the one with the highest capacity featuring seven runways, serves 145 domestic and 47 international destinations. Brunei airport modernisation to boost business

More business opportunities will be available at Brunei International Airport once upgrade works are completed in November 2014, according to officials involved with the project.

Agencies involved in the three-year "modernisation" project are looking to double the current annual passenger capacity. With the construction of a new terminal building and carpark, the airport's yearly passenger capacity is expected to increase from 1.5 million to three million.

The new facilities will increase the airport's floorspace by an additional 18,000 square metres, with about three to four thousand square metres of the space for tenancy to retailers, said John Bennet, a senior project manager from AECOM.

AECOM Asia Company Ltd has teamed up with Singapore's Changi Airport Consultants Pte Ltd to act as consultants for the Brunei Economic Development Board (BEDB) for the project.

"We are trying to modernise and build a more iconic terminal building, which is comparable to most airports in the region...so that the passengers' experience will be further enhanced and facilities better from what it is now," said BEDB assistant CEO Julian Fung.

The renovation work will require business tenants, such as Delifrance and KFC, currently sited just outside BIA's arrival hall, to relocate to an interim "Meeters and Greeters" hall. This is due to construction works affecting the airport's main, short-term P1 car park, in front of the arrival hall.

Fung, who is also BEDB's Head of Infrastructure Development, told The Brunei Times that the vendors have already started to relocate to the interim hall, which is planned to open next week on March 7.

"There will be a number of kiosks in the Meeters and Greeters hall that will be ready for them, and they will be moving their facilities there. So the passengers (will) still experience the same facilities as they have in the existing arrival area," he said.

"But I believe in the new terminal building, there will be more spaces or increased floor area for food and beverage retail...So, the same tenants are welcome to establish themselves in the new terminal, through the Department of Civil Aviation (DCA)," Fung said.

BEDB's project manager Lee San San explained that the DCA as the building owner will ultimately decide through a tender process who the new tenants will be once the upgrade is completed. This means that the availability of future retail space for current airport tenants is not guaranteed at the end of the project depending on the contracts of respective existing tenants.

"The DCA will carry out their usual process maybe a tender process to solicit new tenders to come in to the new airport."

In the meantime, Lee said, business will continue at the airport with only "minor disruptions" anticipated.

"In the midst of our modernisation, we also need to make sure they (are) relocated at appropriate places, while still maintaining some business opportunity there," she said.

"But obviously, throughout this three-year construction period, we'll see some minor disruptions. But in the long run, it will be (of) benefit for the whole community, in terms of the business opportunities that will come in with the increased retail space."

However, under the commercial arrangement with the DCA, existing tenants are bearing all the costs of relocating to the interim hall, and will also have to absorb the costs of moving back into the new retail space at the end of the project should they decide to continue their tenancy at the airport.

"Pretty much to my understanding, it's all the tenants' costs but this gets factored into the commercial terms of their arrangement going down the road," Bennet said.

"We will be providing the basic shell and core facilities the platform, the essential drainage points, the power; but then as far as fitting it out, it all gets borne by them (tenants) as part of their business expense," the consultant added.

A source close to one the tenants, speaking on condition of anonymity, shared the businesses' concerns of not being compensated for the renovation and relocation costs.

"Instead, businesses have to move out and in the future, pay for new renovation costs after the airport upgrade is completed," the source told The Brunei Times yesterday. He also added that the tenants already had to bear similar costs during earlier upgrade works on the airport.

The DCA could not be immediately reached for comment yesterday.
